If you live in Deltona and need the help of a
Central Florida Criminal Defense Lawyer... We Can Help You
In State Court, civil cases are usually filed in the county where at least one of the parties involved resides. But, criminal cases
are not always filed in the county of residence of the person accused. Criminal law cases are usually filed and tried in the
county, in other words, in the venue, in which the criminal offense charged is alleged to have occured.
There are cases, however, in which the prosecution does
not know the precise physical location where the criminal
offense was allegedly committed.
Pursuant to the Florida Constitution and to Florida Statute,
in those types of cases, the person may be charged in two
or more counties conjunctively. Then, the acused would
have the "privilege" of electing in which of those counties he
or she wants the trial to be held and would then present his
or her criminal defense in the county selected.

As you know, Deltona is located in Volusia County, Florida. So if
a crime allegedly took place within the Deltona city limits, the state
criminal case would usually be filed with the Court in Volusia
County. And naturally, the person accused would defend against
the allegations there, aided of course by his or her criminal defense
lawyer.
Even if the person accused actually resided in another county or
another state, this would likely be the case. So the Deltona
residence of the person accused would not revelant to where the
criminal case would usually be filed.
This applies to juvenile delinquency or juvenile defense cases and
to adult felony and misdemeanor criminal cases.

So if someone from Deltona, for example, was charged
with a criminal offense which was supposedly committed
in Seminole County and Volusia County, it would be up
to the accused to elect whether to go to trial in Volusia
County or Seminole County. Of course, the prosecution
would still have to prove venue.
Volusia County Courthouse
In any event, if a Deltona criminal case is tried in Volusia County, the trial will likely be held at the Volusia County
Courthouse in Deland, regardless if its for a felony or a misdemeanor. And if the Deltona juvenile defense is for a juvenile
delinquency case, the case will also be heard in Deland but by a Volusia County Juvenile Court Judge.

In 1859, George Sauls, his wife Adeline, and their six children, became the first settlers in the area which today is
known as Deltona. Back then, the desolate Deltona area was referred to as Saulsville.
Sauls, who was originally from Haw Creek (north of Deltona) served as a secret agent for the Confederates during
the Civil War. Sauls is said to have laid out the Titusville Public Road when, in 1865, he helped a Confederate
General haul a Federal steamboat captured by the Confederate Army from the Deltona area to the Titusville area.
The Deltona area was rather quiet until 1962, when a company purchased 17,203 acres for development. Later
that year, the Mackle Company began construction of homes in the subdivision which they named Deltona Lakes
and, in 1963, the first residents of Deltona Lakes moved in. Interestingly, although Deltona is located
approximately halfway between Orlando and Daytona, the name Deltona is a combination of Deland and Daytona.
The Deltona area was incorporated as the City of Deltona in 1995, on its third try. Today, Deltona has a
population of over eighty five thousand.
